El presente ensayo tiene como objetivo evaluar un caso de desobediencia civil en el Perú: el desacato al decreto supremo que estableció la inamovilidad ciudadana el 5 de abril de 2022 en Lima y Callao. Para este propósito, se presentará el contexto en el que fue decretada y comunicada dicha medida. Luego se examinarán los argumentos a favor de la desobediencia expuestos en los textos Critón de Platón y Del deber de la desobediencia civil de Henry Thoureau para considerar este (...) acto moralmente justificado y necesario. Background Researchers are required to determine whether a person has capacity to consent to a research study before they are able to participate. The Mental Capacity Act and accompanying Code of Practice for England and Wales provide some guidance on this process, but researchers have identified that it can be difficult to determine capacity to consent when a person has complex cognitive or communication needs. This study aimed to understand the experiences and opinions of researchers who recruit people with dementia (...) to research projects, to inform the future development of training resources. Methods A mixed method, cross-sectional, electronic survey was circulated via social media and research networks in England and Wales. The survey remained open for ten weeks and included open and closed questions exploring respondents’ confidence in determining capacity in the context of recruiting people with dementia to consent, their views on training and support they have experienced and their suggestions for future training and support needs. Results 60 respondents completed the survey from across England and Wales. Although 75% of respondents had experience of determining capacity to consent with people with dementia to research, only 13% rated themselves as feeling ‘very confident’ in this. Qualitative content analysis of open responses led to the generation of six themes, explaining researchers’ confidence, competence and future training needs in this area: (1) Researcher uncertainties, (2) Lack of time, (3) Balancing information complexity with accessibility, (4) Gatekeepers, (5) Existing enablers and (6) Envisioning future training. Conclusions Researchers would benefit from specific training in undertaking conversations around consent with people with dementia. People with dementia may have fluctuating capacity, and despite support from caregivers, researchers have little practical guidance on methods of determining a person’s ability to understand or appreciate the information they have provided during the consent process. Given the development of large complex trials within dementia research, there is an urgency to develop specific and practical guidance and training for researchers working with people with dementia and their families. What is hope? Though variously characterized as a cognitive attitude, an emotion, a disposition, and even a process or activity, hope, more deeply, a unifying and grounding force of human agency. We cannot live a human life without hope, therefore questions about the rationality of hope are properly recast as questions about what it means to hope well. This thesis is defended and elaborated as follows. First, it is argued that hope is an essential and distinctive feature of human agency, (...) both conceptually and developmentally. The author then explores a number of dimensions of agency that are critically implicated in the art of hoping well, drawing on several examples from George Eliot’s Middlemarch. The article concludes with a short section that suggests how hoping well in an individual context may be extended to hope at the collective level. (shrink)

In philosophy, the last thirty years or so has seen a split between 'simulation theorists' and 'theory-theorists', with a number of variations on each side. In general, simulation theorists favour the idea that our knowledge of others is based on using ourselves as a working model of what complex psychological creatures are like. Theory-theorists claim that our knowledge of complex psychological creatures, including ourselves, is theoretical in character and so more like our knowledge of the world in general. The body (...) of this paper is divided into three parts. In Part I, I introduce the 'contrastive case' of autism. Autism is a developmental disorder that has recently become the focus of sustained philosophical and psychological attention because of the selective way in which it affects individuals' social capacities. Theory-theorists argue that autistic children's unique profile of assets and deficits is most fruitfully explained by their inability to develop and deploy a theory of mind. After considering the strengths of this hypothesis, I claim theory-theorists face two unresolved difficulties: explaining why high-functioning autistics who develop some theory of mind capacities still fail to engage in normal psychological knowing; and explaining why autistics are generally as unknowable to us in the privileged sense of normal psychological knowing as we are to them. In Part II, I provide the theoretical framework for addressing these challenges by developing an account of normal psychological knowing as psycho-practical expertise. In Part III, I return to the problem of autism, showing how this psycho-practical approach to normal psychological knowing may further suggest how to encompass various aspects of the disorder that tend to be ignored under the prevailing theory-theory approach. Background As our society is ageing, nursing homes are finding it increasingly difficult to deal with an expanding population of patients with dementia and a decreasing workforce. A potential answer to this problem might lie in the use of technology. However, the use and application of surveillance technology in dementia care has led to considerable ethical debate among healthcare professionals and ethicists, with no clear consensus to date. Aim To explore how surveillance technology is viewed by care professionals and ethicists (...) working in the field, by investigating the ideal application of surveillance technology in the residential care of people with dementia. Methods Use was made of the concept mapping method, a computer-assisted procedure consisting of five steps: brainstorming, prioritising, clustering, processing by the computer and analysis. Various participants (ranging from ethicists to physicians and nurses) were invited on the basis of their professional background. Results The views generated are grouped into six categories ranging from the need for a right balance between freedom and security, to be beneficial and tailored to the resident, and clearly defined procedures to competent and caring personnel, active monitoring and clear normative guidance. The results are presented in the form of a graphic chart. Conclusions There appears to be an inherent duality in the views on using surveillance technology which is rooted in the moral conflict between safety and freedom. Elaboration of this ethical issue has proved to be very difficult. (shrink)

Although there is now a substantial body of literature exploring the effects of language diversity in international management contexts, little attention has been paid to the ethical dimensions of language diversity at work. This conceptual paper draws on the concept of epistemic injustice in order to explore how language, and in particular corporate language policies, may act as a source of epistemic injustice within the workplace. It demonstrates how language competence affects credibility judgements about a speaker, and also considers how (...) corporate language policies can create situations of hermeneutic injustice, in which marginalised groups are denied the vocabularies to understand their own experiences. Finally, ways in which such epistemic harms can be reduced are discussed, and the possibilities for management education to create epistemically responsible managers are highlighted. (shrink)

O abuso sexual infantil se enquadra entre as formas de maus-tratos na infância e traz sérias consequências ao desenvolvimento psicológico. Este trabalho teve como objetivo conhecer a percepção de psicólogos que trabalham ou já trabalharam com casos de abuso sexual infantil, sobre os efeitos da situação de violência no psiquismo da criança e sobre o papel da mãe nesse contexto. Participaram do estudo 4 psicólogas que possuíam, no mínimo, 5 anos de experiência de atendimento clínico a crianças vítimas de abuso (...) sexual, sendo realizada uma entrevista semidirigida com cada uma delas. Para a análise de dados, utilizou-se a análise de conteúdo, segundo Bardin, que revelou a importância central do suporte materno para o enfrentamento do trauma sofrido pela criança e para o tratamento psicoterapêutico. A falta desse suporte pode estar associada a aspectos inerentes ao psiquismo da mãe, fazendo com que ela não consiga oferecer ao filho as medidas protetivas necessárias. (shrink)

KEY POINTS In Canada, commercial data brokers collect deidentified patient data from pharmacies, private drug insurers, the federal government and medical clinics without patient consent. Although pharmaceutical companies are the data brokers’ primary customers, academics and nonprofit and public entities also use commercial data sets, given the absence of a coordinated public approach to collecting these data across Canada. Risks of commercialized patient data include loss of anonymity, surveillance and marketing, discrimination and violation of Indigenous data sovereignty. Coordinated infrastructure for (...) the collection and coordination of health data across Canada and updated privacy legislation would protect individuals and communities and enable appropriate data uses. PurposeThis paper aims to investigate behavioural changes related to self-censorship (SC) in social networking sites (SNSs) as new methods of online surveillance are introduced. In particular, it examines the relationships between SC and four related factors: privacy concerns (PC), privacy awareness (PA), perceived vulnerability (PV) and information management (IM).Design/methodology/approachA national wide survey was conducted in the UK (N= 519). The data were analysed to present both descriptive and inferential statistical findings.FindingsThe level of online SC increases as the level of privacy (...) concern increases. The level of privacy concern increases as the levels of PA and PV increase and the level of effective IM decreases.Originality/valueThis study extends the literature on online SC, showing that PCs increase the level of SC in SNSs. O texto estrutura-se como um relato de experiência acerca das implicações da pesquisa autoetnográfica, associada ao conceito de exotopia proposto por Bakhtin (2010) em dissertação de mestrado profissional em Letras (PROFLETRAS). A pesquisa envolveu a atividade de revisão e reescrita em sala de aula, com alunos do 7º ano do Ensino Fundamental II, com o intuito de trabalhar a produção de textos como experiência subjetiva e dialógica com a língua(gem). A autoetnografia e a exotopia, interligadas pelo conceito dialógico na perspectiva (...) bakhtiniana, tornaram-se métodos e procedimentos fundamentais para o desenvolvimento das atividades didáticas em que os papeis de professora e pesquisadora fundiam-se na busca da resolução de problemas junto aos alunos participantes dessa experiência. Es handelt sich um die folgenden Texte: Butlers Gender Trouble, die 1990 veröffentlicht wurde, Halberstams Female Masculinity, die 1998 herausgebracht wurde, und Preciados Testo Yonqui, die 2008 verlegt wurde. Die Analyse-Technik, die ich für das detaillierte Lesen der Texte angewendet habe, ist die so gennante Technik des hermeneutischen close reading, die auch im Laufe des Artikels zur Erklärung gebracht wird. Restorative justice should have greater weight as a criterion in criminal justice sentencing practice. It permits a realistic recognition of the kinds of harm and damage caused by offences, and encourages individualized non-custodial sentencing options as ways of addressing these harms. Non-custodial sentences have proven more effective than incarceration in securing social reconciliation and preventing recidivism, and they avoid the serious social and personal costs of imprisonment. This paper argues in support of restorative justice as a guiding idea in sentencing. (...) As part of this defence, it considers whether the use of the idea of restorative justice will conflate criminal law with civil law or displace the authority of the criminal courts, and whether the sentences it recommends are best thought of as punishments or alternatives to punishment. BackgroundSocial media has globalised compassion enabling requests for donations to spread beyond geographical boundaries. The use of social media for medical crowdfunding links people with unmet healthcare needs to charitable donors. There is no doubt that fundraising campaigns using such platforms facilitates access to financial resources to the benefit of patients and their caregivers.Main textThis paper reports on a critical review of the published literature and information from other online resources discussing medical crowdfunding and the related ethical questions. The review (...) highlighted the benefits of crowdfunding as well as the under-exploration of the risk of having patients’ desires and human rights undermined during online fundraising campaigns. Majority of these campaigns get initiated on behalf of the patients, especially the very sick and dependant. The ethical questions raised relate to the voluntariness of informed consent and the possibility of patients being used as a means to an end. Vulnerability of patients may expose them to coercion, undue influence, manipulation, and violation of their human rights. The success of these campaigns is influenced by the digital skills, pre-existing social networks and, the emotional potency. Healthcare is a public good, and online market forces should not determine access to essential health services. The benefits of crowdfunding cannot be subverted, but it can perpetuate unintended injustices, especially those arising from socio-economic factors.ConclusionsPolicymakers ought to monitor the utilisation of crowdfunding sites to identify policy failures and unmet essential health care needs responsible for driving individuals to use these platforms. The upholding of human rights and the fundamental respect of the individual’s wishes is a moral imperative. The need for an ethics framework to guide different stakeholders during medical crowdfunding needs further examination. (shrink)

This essay evaluates Charles Taylor's defence of a politics of recognition in light of his broader account of modern identity and the self. I argue that his call for a politics of recognition betrays what is most ethically promising in his own account of modern subjectivity – namely, its emphasis on and affirmation of inner multiplicity. The first part of the paper identifies the ways in which his account of the self affirms inner multiplicity. The second part of the paper (...) outlines how a politics of recognition circumscribes this inner plurality by rendering core aspects of personal identity rigid and by promoting attitudes that inhibit attentiveness to multiplicity within the self. By outlining the ways in which it circumscribes inner multiplicity, I show that Taylor's preferred form of politics undermines two of his own central goals: that of securing the conditions in which authentic identity can be realized and that of promoting mutually receptive relations among diverse selves. A form of liberalism that strives for neutrality with respect to cultural symbols and practices more effectively facilitates the realization of these goals. (shrink)

Positivist medical historians, guided by the savoir of modern western biomedicine, have long depicted medieval medicine as an aberration along the continuum of scientific and medical progress. Historical epistemology, founded in the ideas of Cavailles, Foucault, Davidson, and Hacking, however, allows the historian to disrupt this false continuum and to unchain medieval medicine from modern medicine. Postmodernist approaches, such as those sourced in Lyotard, Barthes, and Derrida, allow the historian to further deconstruct medieval and modern medical discourse, revealing a multitude (...) of narrative lenses spinning around biomedical and biocultural strands. In liberating these two medical systems and setting them within the distinct historical and epistemological contexts that both shaped and were shaped by them, the historian can revision the theories, practices, and culture of medieval medicine without having to anachronistically justify them according to modern medical discourse. This comparative case analysis contrasts two nations – Viet Nam and The United States of America (U.S.) – in terms of processes each employed and results each achieved in respective response to the COVID-19 pandemic. We use a general theory of teaching to contrast the countries in terms of their approaches to COVID public health education. Viet Nam followed the recommendations of the theory. The U.S. did not. While our analysis does not and cannot prove educational theory acted as the (...) sole causal factor in realization of the disparate results in the countries, our case study does illustrate that the different approaches to public health education used by the countries may be counted among factors contributing to wide differences in the contrasting cases. The argument proceeds by 1) describing differences in relevant statistics between Viet Nam and the U.S., 2) outlining the theory of teaching we use to analyze differences in public health education in the two contexts, and 3) discussing successful implementation of the theory in Viet Nam and failure to implement in the U.S. Finally, we 4) dismiss competing explanations of differences between the countries and 5) offer considerations about how the U.S. may educate citizens away from turning the pandemic into a pan(en)demic. In Building Better Beings, Vargas develops and defends a naturalistic account of responsibility, whereby responsible agents must possess a feasibly situated capacity to detect and respond to moral considerations. As a preliminary step, he also offers a substantive account of how we might justify our practices of holding responsible—viz., by appeal to their efficacy in fostering a ‘valuable form of agency’ across the community at large, a form of agency that precisely encompasses sensitivity to moral considerations. But how do these (...) accounts relate to one another? Though I find much that is appealing in Vargas’s general approach, I challenge his insistence that these accounts should be treated as ‘conceptually independent’, arguing that this generates an objectionable “justification gap”: on his analysis, someone could remain an appropriate target of our responsibility practices and yet fail to be a morally responsible agent. In closing, I offer a potential solution to this problem, though it means re-visioning how the account of moral responsibility is conceptually tied to the justification of our responsibility practices. This empirical study reports the implementation and assessment of service learning in management education. Principles of Management students worked in teams to support Campus Kitchens, a national program affiliated with colleges and universities, in recovering surplus food and delivering it to community members. Student perceptions regarding civic engagement and social responsibility, application of skills, and professional development were assessed. Two complete cycles of implementation and assessment are chronicled. The sample size for Cycle 1 was 123 students and for Cycle 2 (...) the sample size was 91 students. Este artículo se inscribe en el debate acerca de los procesos de recepción en relación a los consumos mediáticos. Específicamente, se analizan las interpretaciones y construcciones de sentidos que los públicos hacen de las noticias de inseguridad. Para ello se propone los siguientes objetivos: en primer lugar, debatir los fundamentos de los conceptos de audiencias y públicos en las investigaciones en comunicación; en segundo lugar, indagar en distintas dimensiones sobre el proceso de recepción y circulación de las representaciones mediáticas del (...) delito como las llamadas “olas de inseguridad”, la credibilidad de las noticias y la incidencia de la reiteración de la misma información en los consumidores mediáticos. A partir de un estudio cualitativo, basado en entrevistas en profundidad con sujetos que habitan en dos barrios porteños con alta percepción del delito y el uso de disparadores audiovisuales (noticias de inseguridad), el trabajo cuestiona el lugar de los medios de comunicación como principales actores en la generación de temores sociales. En cambio, se propone vislumbrar distintos entramados de sentido, e incluso ir más allá de los medios, para observar el papel fundamental que tiene la experiencia y la comunicación interpersonal en los procesos de consolidación de determinadas creencias y comportamientos sobre la inseguridad. This article explores an aspect of women’s transnational labor migration that has been understudied in many labor-sending countries: how men experience shifts in the household labor division triggered by women’s migration. In so doing, we shed light on the diverse ways notions of masculinity and gender identities are being reworked and renegotiated in the transnational family. Drawing on qualitative data collected from in-depth interviews with carers of left-behind children in Northern Vietnam, we show how men are confronted with the need (...) to take on child care duties, which have traditionally been ascribed to women, while at the same time being under considerable pressure to live up to locally accepted masculinity ideals. We provide interesting insights into the changing family structures and dynamics in Vietnamese society where patriarchal norms continue to exert significant influence on different facets of life. This paper examines the methodological claim made famous by P.F. Strawson: that we understand what features are required for responsible agency by exploring our attitudes and practices of holding responsible. What is the presumed metaphysical connection between holding responsible and being fit to be held responsible that makes this claim credible? I propose a non-standard answer to this question, arguing for a view of responsible agency that is neither anti-realist (i.e. purely 'conventionalist') nor straightforwardly realist. It is instead ‘constructivist’. On (...) the ‘Scaffolding View’ I defend, reactive attitudes play an essential role in developing, supporting, and thereby maintaining the capacities that make for responsible agency. While this view has relatively novel implications for a metaphysical understanding of capacities, its chief virtue, in contrast with more standard views, is providing a plausibly defensible account of how so-called responsible agents genuinely deserve to be treated as such. Despite a growing body of research by management scholars to understand and explain failures in ethical decision making (EDM), misconduct prevails. Scholars have identified character, founded in virtue ethics, as an important perspective that can help to address the gap in organizational misconduct. While character has been offered as a valid perspective in EDM, current theorizing on how it applies to EDM has not been well developed. We thus integrate character, founded in virtue ethics, into Rest’s (1986) EDM model to (...) reveal how shifting attention to the nature of the moral agent provides critical insights into decision making more broadly and EDM specifically. Virtue ethics provides a perspective on EDM that acknowledges and anticipates uncertainties, considers its contextual constraints, and contemplates the development of the moral agent. We thus answer the call by many scholars to integrate character in EDM in order to advance the understanding of the field and suggest propositions for how to move forward. We conclude with implications of a character-infused approach to EDM for future research. (shrink)

The medicalisation of pregnancy and childbirth has been encouraged by the continuing growth of technology that can be applied to the reproductive journey. Technology now has the potential to fully separate reproduction from the human body with the prospect of ectogenesis—the gestation of a fetus outside of the human body. This paper considers the issues that have been caused by the general medicalisation of pregnancy and childbirth and the impact that ectogenesis may have on these existing issues. The medicalisation of (...) pregnancy and childbirth is criticised for its impact on the relationship between doctors and pregnant women and the way in which doctors treat fetuses. It is argued that ectogenesis may cause more imbalance in the doctor and intended parent relationship and may result in an increased lack of clarity regarding a doctor’s duty to the fetus. This paper finds that extensive guidance and revised legislation will be necessary to minimise the impact of ectogenesis on the existing issues caused by the medicalisation of reproduction. (shrink)
